Moitra urges Centre to ensure proper legal representation in Old Goa bungalow case

Says owners of the illegal construction shouldn’t be allowed to take advantage of procedural lapses of the administrative agencies

PANJIM: Trinamool Congress (TMC) MP Mahua Moitra has written to the Union Minister for Culture G Kishan Reddy to ensure proper legal representation before the High Court of Bombay at Goa at the next hearing on alleged illegal structure at Old Goa. 

She said that the illegality cannot be condoned on technicality. 

In a letter to the Union Minister, Moitra expressed shock over how time and again the owners of the said illegal construction i.e. now allegedly Corvus Urban Infrastructure LLP, Mumbai are being allowed to take advantage of procedural lapses on the part of the administrative agencies/departments of both – Government of India and the Goa government.

“If only, the proper procedure was complied with by the concerned government departments, the said orders would neither have been stayed nor quashed. It is absolutely clear that this illegal construction is being protected by certain individuals within the government departments by deliberately not complying with the due process and the procedures established by law,” Mahua stated. 

“As a result, the owners of this illegal construction are able to exploit technical loopholes to avoid demolition of the illegal construction and prosecution for their wrongdoings. Hence, I implore you to call for an inquiry and investigate this matter,” she said in her letter.

The writ Petition pertaining to the illegal Old Goa bungalow is scheduled to be heard before the High Court of Bombay at Goa on November 15. 

By order dated September 8, the High Court quashed and set aside the order revoking the technical clearance and the order disconnecting the electricity connection to the structure only because, the government failed to comply with the principles of natural justice and fair play.
