Police Sub-Inspector Nerlon Albuquerque has filed a writ petition in the High Court of Bombay at Goa seeking retrospective promotions to the post of police inspector.
In his writ, Nerlon has contended that he was eligible to be promoted to the post of PI in 2007 but was denied the same without giving any valid grounds. The PSI has placed reliance on his service records to support his claim for the retrospective promotions.
Prior to filing of the petition, Mumbai-based counsel Adv Narendra Bandiwadekar on behalf of Nerlon had sent a legal notice to the Director General of Police stating that his action of not promoting the PSI was totally illegal, bad in law and contrary to the rules as well as service jurisprudence and had called upon the top boss of Goa Police to the rectify the mistakes committed.
It may be recalled that Nerlon was summarily dismissed from service over allegations of procedural lapses committed while conducting investigations into the death of British teenager Scarlet Keeling.
The Government withdrew the dismissal order after the PSI knocked the doors of the High Court. Subsequently, a departmental inquiry was conducted against him. On culmination of the inquiry the IGP in an order stated that the PSI handled the case in a normal and routine manner and observed all formalities to be done in such cases by informing senior officers.
The IGP’s order further states that the expectations were high for prompt actions because of the case being strongly highlighted in the media. “However, a minor punishment came to be imposed upon Nerlon for deputing a probationary PSI to conduct initial investigation into the Scarlet case. The PSI has been reinstated active service with effect from November 30, 2009,” it stated.
