No conversion sanads, no construction permissions

MARGAO: Around 20-odd construction files seeking development permissions from the South Goa Planning and Development Authority (SGPDA) will be returned back to the developers with Goa government's circular not to grant development permissions and technical clearances sans conversion sanads coming into effect this month.

MARGAO: Around 20-odd construction files seeking development permissions from the South Goa Planning and Development Authority (SGPDA) will be returned back to the developers with Goa government’s circular not to grant development permissions and technical clearances sans conversion sanads coming into effect this month.
Sources in the SGPDA said these files seeking development permissions were not accompanied by conversion sanads, adding that the real estate developers will have to re-submit the files for development permissions only after obtaining conversion sanads from the competent authorities.
The circular issued by the Chief Town Planner S T Puttaraju dated July 8 implies that neither the Planning and Development Authority nor the TCP Department can issue technical clearances and development permissions for any constructions or development without a valid conversion sanad.
Presently, the PDA or the TCP offices used to issue the development permissions and technical clearances to the construction projects on condition that the builder obtains the conversion sanad at the time of completion of the project.
The Circular drew attention of the PDA and TCP departments to the government decision to implement provisions of Section 32 of the Land Revenue Code strictly, with Puttaraju directing the district offices/taluka-level offices and Planning and Development Authorities that no technical clearances/development permissions shall be issued for any construction/development without valid conversion sanad.
“As per the Goa, Daman and Diu Land Revenue Code, 1968, under section 30, no land used for agriculture shall be used for any non-agriculture purpose without obtaining conversion of use of land from one purpose to another under section 32 of the Land Revenue Code,” the circular stated.
Apart from the PDAs and TCP offices, the circular stated that even local authorities were issuing construction licenses after imposing conditions, but added that “in many instances, the individuals may not obtain conversion sanad as contemplated under section 32 of the LRC even after completion of the construction/development.”
