The National Investigating Agency (NIA) has finally filed the charge sheet before the South Goa sessions Court on Monday in the absence of a special court constituted by the government.
When this question was posed to the NIA, it’s Superintendent of Police, S Vijayan said the Agency has already moved the Bombay high court to notify the special court, while admitting that the charge sheet was filed before the sessions court in the absence of the special court.
Legal sources, however, said there’s a clear-cut provision in the NIA Act which empowers the Agency to file the charge sheet in the sessions court in the absence of a Special Court.
IN fact, sources in the know said the Sessions court Judge may even commence trial in the case, adding that the delay in the constitution of the special court would not at all hamper the trial.
