Now, GIDC approval must for all transfers, sub-leases of industrial plots

PANJIM: Providing major relief to Goa’s industrial sector, the State government notified the amended Goa Industrial Development Corporation (GIDC) Transfer and Sub-lease Regulations 2018, focusing on bringing in transparency in the transfer of industrial plots-cum-properties owned and controlled by the corporation on lease or sub-lease. 
The new regulation places a ban on transfer of plots for red or negative industries like tobacco and liquor. All pending applications for transfer or sub-lease will be cleared as per the new regulations, which make GIDC approval a must.
Currently the 2016 regulations are in place for transfer of plots on lease or sub-lease basis. 
“…the industry represented to the government that the process of allotment, transfer and sub-lease of GIDC plots continues to be affected by inordinate delay, indecision, misinterpretation, confusion, heavy levies and penalties. This has adversely affected industrial activity and development in Goa. Ease of doing business has also suffered,” IDC managing director Narayan Gad said in the notification.
Gad said that in order to rejuvenate industrial activity and development, and to attract new industrial investment, the government decided to amend the regulations relating to transfer and sub-lease of GIDC plots.
The new regulation focuses on expediting approval of bonafide applications for transfer and sub-lease of plots, eliminate speculative and unauthorised transfer and sub-lease and to provide one-time opportunity for regularising unauthorised transfer and sub-lease transactions by payment of fees and penalty.
The new regulations make it clear that no allottee is permitted to convey/transfer the leasehold rights of the plot allotted to a third party or individuals or entities without the Corporation’s approval. No land/plot allotted to the allottee for a kiosk under any scheme of the government is permitted to be transferred.
The Corporation has to clear the file for transfer or sublease within 21 days. The transfer and sublease fees are applicable between 40 per cent and 10 per cent of the prevailing plot rate per sq mtrs of plot area. These plots include where there was substantial construction but not put to use, the plots or units which is or was in use, transfer initiated by banks or auctions, etc.
