MARGAO: The occupancy certificate issued to a portion of the commercial building near Ravanfond railway over-bridge has been kept in abeyance till January 20.
The occupancy certificate has been kept in abeyance by the Margao Municipal Council following a direction from the Director of Municipal Administration (DMA).
A Margao resident Shirish Kamat filed an appeal against the construction licence issued by the municipality for the construction. Disposing the appeal, the DMA directed the municipality to keep the occupancy certificate in abeyance.
A shopping mall already started furnishing the building to start operation after obtaining occupancy certificate from the municipality, which is now kept in abeyance on the order of DMA.
Kamat had filed the Appeal under Section 293 read with Section 2 of the Goa Municipalities Act, 1968 and prayed for stay before the DMA against the operation of the occupancy certificate dated November 18, 2019. The appellant had claimed that issuing occupancy certificate to part of a building is unlawful.
According to appellant Kamat, the commercial building near Ravanfond railway over-bridge is built on a land declared as open space.
“Once an open space is always an open space and there are court orders to state that. I will fight this until justice is delivered in this case,” Kamat said in his appeal.
Grapevine has it that the property is being co-developed by a politician and he is pressuring the authorities to go soft on the issue.
