One granted bail in rape case

PANJIM: The High Court of Bombay at Goa on Thursday granted bail to Rabbani Shaikh, who was arrested on the charge of raping a girl.

The court ordered that Shaikh be released on a bond of Rs 20,000 with one surety in the like amount. He has been asked not to enter the jurisdiction of Socorro village during the pendency of the trial and to attend the proceedings before the trial court on each and every date. 

Shaikh has also been asked not to contact the victim in any manner either himself or through any other person and also not to take any steps that would amount to tampering of the evidence or influencing the witnesses. In case of any violation of the conditions, the bail granted to the applicant shall be liable to be cancelled.

The Porvorim police had arrested Shaikh in September last year following a complaint by the victim’s father that the accused was stalking his daughter and threatening her with dire consequences by taking advantage of their friendship. 

He was arrested under Section 354D (Stalking) and 506 (ii) of the Indian Penal Code and was released on bail by the Judicial Magistrate First Class (JMFC), Mapusa.

But during recording of statement of the victim under Section 164 of the CrPC, the victim made serious allegations of forcible sexual intercourse leading to addition of the offence under Sections 376 of IPC against the applicant. The police completed investigations and charge sheeted the accused under Sections 354D, 376 and 506 (ii) of the IPC on October 29, 2020.
