PANJIM: Atmaram Kambli, who has filed a writ petition against the Goa government against acquisition of land for the Greenfield Airport at Mopa, has accused the government of trespass on the acquired land for the proposed Mopa airport. In a press release issued here, Kambli claimed that he has served the government a legal notice which seeks to restrain the authorities (State government and Directorate of Transport) of interfering with the land in the Varconda village which, he claims is not a revenue village of the State.
The petitioner Kambli has taken recourse to the order issued by the High Court on a petition filed by him earlier where the court while disposing off the petition had said: “We do not propose to comment on the validity of the submissions made in the petition regarding the legal issue,” and another one, “Needless to state, if the petitioner has any one remedy available in law, dismissal of this petition will not come in his way from taking recourse to it.”
The petitioner claims that they are vested with the proprietorship in the lands of Varconda covered by notification under section 4 and 6 of the Land Acquisition Act and are therefore not occupants or tenants of any land therein as foreseen by the provisions of the Goa Land Revenue Code. He has also alleged that the village does not belong to the persons whose names are shown as occupants, owners or landlords or tenants according to information provided under the Record of Rights.
The petitioner has alleged that they do not have any title documents and are making use of forged documents and by using these documents they have wrongly claimed the compensation awarded by the concerned authorities and have given consent to take over possession of the land that does not belong to them.
“No such rights stand conferred by the State on any such persons to justify the entry of their names in such Record of Rights.”
