Pooja Sharma evading arrest, Crime Branch tells Court

Bail plea hearing adjourned; Adv Desai claims his client was totally innocent; says politics involved in case; insists Pooja had not received any notice asking her to appear before police for investigation

PANJIM: The Principal District and Sessions Court, Panjim on Friday adjourned to Saturday, hearing in the anticipatory bail application filed by Pooja Sharma, alleged accused in the Assagao house demolition case. 

The arguments on the anticipatory bail application started on Friday, wherein Public Prosecutor Mandrekar submitted to the Court that even after sending three notices to Pooja Sharma to appear before the investigating officer, she filed anticipatory bail application. The third notice under section 41 A of CrPC was sent on Friday and she has been evading arrest since the commission of the crime. 

But arguing on behalf of the applicant, senior advocate Surendra Desai told the court that his client had not received any notice asking to appear before the police for investigation. 

Adv Desai claimed that his client was totally innocent and will prove that there was a lot of politics involved in it. As per the complaint, one person named Arshad Khawaja (broker) was active on behalf of the previous land owner Chrys Pinto, he said adding that Pooja Sharma was now the rightful owner of the property and had right to take possession of it. He said that Agarwadekar family were trespasser into her property. 

“Law grants me authority to throw out the trespasser. I being a lawyer, lodged my complaint against the Agarwadekar family for criminal trespassing. Pradeep Agarwadekar is a resident of Chapora and trespassed on my property and illegally occupied the house,” the senior advocate told the court. 

Adv Desai said that Khawaja seems to be the mastermind and main accused in the demolition of the house. But he has been released on bail. “The Crime Branch ise playing mischief and trying to protect the trespasser,” charged Adv Desai.

The Crime Branch in its say has submitted that Pooja Sharma is the kingpin behind the entire incident, which occurred at Assagao on June 22. Sharma claims to be the owner of the property by virtue of sale deed and therefore she is the mastermind behind the incident to forcibly drag out Agarwadekar family from the house and further demolish the structure in high-handed manner by deploying goons and by hiring an excavator. The arguments will continue on Saturday.
