Prima facie case against Babush, others: court

MAPUSA: The CBI court on Friday stated that there was prima facie case to frame charges against Santa Cruz MLA Atanasio Babush Monserrate, his wife and Taleigao MLA Jennifer Monserrate and 35 others in connection with the attack on Panjim Police station in 2008. CBI court Judge P V Savaiker has fixed the date for further arguments on September 23.

Judge Savaiker made these observations after going through the charges levelled in the chargesheet filed by CBI and on hearing arguments of both the prosecution and defence. 
The CBI had submitted the chargesheet before the court last year alleging that due to the “inflammatory, incitive and provocative speech of then Taleigao MLA A Monserrate”, the “unlawful assembly” became violent and caused injuries to the police and damaged the police station on February 19, 2008. 
The chargesheet was filed by CBI under Sections 143, 147, 148, 153, 324, 325, 326, 332, 343, 427 and 435 of IPC and Section 3 of Prevention of Damage to Public Property.
Monserrate and others had challenged the chargesheet stating that the allegations were untenable. The arguments in this matter from both the sides were completed on July 18 and the order was fixed for August 13, which was later postponed to September 12. Babush, Jennifer and the other accused were present in the court.
