PANJIM, SEPT 15
The Bombay High Court at Goa today granted conditional bail to Virendra Prabhudesai in connection with the alleged rape of a 19-year-old girl. Justice Nelson Britto observed that the relationship between the victim and the accused appeared to be mutual.
The Court read out the victim’s statement to the police that she had a mutual relationship with her fiancé (the accused) and that the parents of both families agreed get them married. Defence Counsel Amit Palekar brought these points to the notice of the Court during arguments for bail.
“In that case the applicant could not have been denied bail by the Sessions and Additional Sessions,” the order entails.
Prabhudesai, 28, a resident of Headland-Sada was arrested by Mormugao police in mid-August for allegedly raping the girl. The accused moved the High Court after his bail was rejected by lower Courts at Margao.
The victim had complained that in the second week of March Prabhudesai drugged her, shot nude pictures of her on his mobile and had intercourse with her.
The victim also alleged that the accused later blackmailed her into having sexual relationship with him several times by threatening to circulate the MMS to her parents and his friends, which apparently went on for five months.
The girl also informed the police that when she became pregnant, the alleged accused assaulted her with the help of his sister-in-law and forced her to consume tablets to induce an abortion.
