NEW DELHI: The Supreme Court has issued a notice to the State government, limited to the question of the quantum of punishment on a petition filed by Pritesh V Naik, who was dismissed from service in November 2012 as a driver in the Goa Police. It posted a further hearing on August 26.

A resident of Bicholim, Naik was ousted from service along with Santosh K Sawal after a departmental inquiry while Sahadev Sawal, the third person in the inquiry, was penalised with reduction in pay as per the Goa Police subordinate Service (Discipline and Appeal) Rules, 1975.
Naik came to the top court against the Goa Bench of the Bombay High Court dismissing his writ petition on August 17, last year. A Bench of Justices Dinesh Maheshwari and Aniruddha Bose on Monday passed the order on submissions by his counsel Nitin S Tambwekar on discrimination in awarding the punishment.
The lawyer referred to an order dated 07.11.2012 reducing the pay of the delinquent despite imputations against him of rather graver degree whereas petitioner Naik was dismissed from service.
He said, “This aspect of the unexplained disparity was not gone into appropriate consideration by the High Court.”
