School ‘floored’ by HC order

Gets court rap, ordered to operate from ground floor for physically challenged students

PANJIM: The Bombay High Court at Goa on Thursday directed the management of the People’s High School to comply with the order of the Commissioner for persons with disabilities dated February 17, 2016 and file a compliance report regarding the shifting of its School for Appropriate Learning (SFAL) at Mala to its original place on the ground floor. Presently, it’s being operated from the first floor.
Earlier, the People’s High School management had approached the High Court challenging the order of the Commissioner for Persons with disabilities to reinstate the SFAL at Mala on ground floor from the current first floor, on a priority basis.
“It becomes extremely difficult for the physically challenged students to attend classes on the first floor. Hence, we had approached the Education Department and Commissioner of persons with disabilities and a notification was issued to the school management to shift the classroom to the ground floor but the school management did not abide by the notification and this led us to approach the High Court,” said Collin Curry the petitioner.
“The High Court has asked the school management to file a compliance report within two weeks after the Diwali vacations. The school did not follow the notification issued by the Education Department and the  Commissioner for persons with disabilities and that forced us to approach the High Court with the support of the parents of the affected children, as it was becoming extremely troublesome for the wards to attend the classes on level one,” said advocate, Satish Mahambrey
It may be recalled that the Commissioner for persons with disabilities, had issued a notification on 17/02/2015 to the management of the People’s High School, to shift the SFAL on the ground floor and based on this notification of the Commissioner for persons with disabilities, the High Court had also asked the school management to shift the classes on the ground floor.
Meanwhile, Director of Education, G.P. Bhat had also written a letter to the chairman of the People’s High School management to completely shift the SFAL school from the first to the ground floor and also the parents of the children had been demanding the same.
