PANJIM: North Goa Principal District and Sessions Judge on Tuesday heard the arguments in the intervention application filed by social activist Kashinath Shetye in the anticipatory bail application filed by former chief minister Digambar Kamat and four others and the matter is posted for order on July 13.
Adv Marvin D’Souza representing Shetye, quoting a Bombay High Court judgement, argued that in matters of anticipatory bail, the complainant and the first informant should be heard.
Adv D’Souza argued that on September 15, 2012, the complaint was filed by Shetye and the High Court had ordered that an FIR be registered. However, the HC order was stayed by Supreme Court later. But this stay, he argued, was obtained by some other individuals and not the five accused persons who have move the application for anticipatory bail.
It may be recalled that Principal District and Session Court last month had granted interim bail to Kamat, Arvind Lolienkar and Agnelo D’Souza, former mines officials and two miners, Harish Melvani and Arjun Salgaonkar.
Shetye had filed the intervention petitions in all five anticipatory bail applications.
Kamat, Lolienkar, D’Souza, Melvani and Salgonkar had field anticipatory bail application before the court after SIT summoned them for questioning.
