MARGAO: South Goa Additional Sessions Judge Vincent D’Silva on Tuesday acquitted the accused charged by the Margao police in the 2010 Moti Dongor gang war case for want of evidence.
The accused ~ Lalshab Bhawar, Anuwar Tambacwale, Navishab Bhawar, Rambany Tambacwale, Rafik Tambacwale and Rafik Bhawar who were charged under section 341, 143, 147, 148, 323, 326 and 307 of IPC were acquitted, while the court has reserved its order in respect of accused Bashir Sheik who is absconding.
Mackbula Shirse, resident of Moti Dongor, Margao, a driver of a mini-bus, had filed a complaint with the Margao police stating that on December 28, 2012 at 2.45 pm the main accused Bashir along with seven others, including a minor, armed with deadly weapons wrongfully restrained his bus near St Joaquim chapel, Borda, Margao and assaulted him and his conductor Kadar Gawas causing them grievous injuries.
The Judge observed that the names figuring in the complaint and the charge sheet were different, and that though there were two separate incidents, one at Borda and the other at Moti Dongor, no two separate charge sheets were filed. The Judge further said though the police had attached six dandas, they had produced only four in the court, adding that the hurt certificate produced before the court turned out to be a different person. The Judge also made a mention that the police did not attach the blood soaked clothes.
