PANJIM: The Town and Country Planning (TCP) Board has partly allowed the appeal and set aside the impugned revocation order-cum-rejection of revised plan passed by the North Goa Planning and Development Authority (NGPDA), related to an alleged illegal construction along the Atmaram Borkar Road, Panjim.
The TCB Board in its order dated January 5, 2024, had directed the NGPDA to consider and approve the revised plan submitted by Narendra Shah on March 20, 2022 by granting relaxation in respect of setbacks, coverage and parking requirement if any, on such terms and conditions as per Provision of the applicable Regulations, 2010.
In August last year, following directions by the High Court of Bombay at Goa, the NGPDA has directed Shah to demolish the illegal construction within one-month from the issuance of the order failing which the Authority shall demolish the said illegal structure and recover the cost of the demolition from the violators.
The NGPDA has also rejected the Revised Plan dated March 28, 2022 submitted by Shah and others as the said deviations were beyond the scope of relaxation of the Authority as per the Regulation 3.8 of the Goa Land Development and Building Construction Regulations, 2010.
While hearing a writ petition filed by Rasiklal Gangani of Panjim, the High Court had observed that no part of deviation which is otherwise a major deviation including the encroachment on public road, be condoned by the NGPDA.
Expressing his surprise at the TCB Board order, Gangani said that he will challenge it before the High Court. He claimed that the building was built in total violation and deviation from the plan approved and without maintaining proper setback.
