Tiracol case adjourned, to be heard today

PANJIM: The High Court of Bombay at Goa on Tuesday adjourned the ongoing Tiracol golf course case for Wednesday following Leading Hotels asking for permission to construct two sample villas.

The court will decide on whether to impose an interim stay on the golf course resort project on Wednesday.
The request by Hotels to construct two sample villas was met with opposition from the St Anthony Mundkar and Tenants Association who requested for an inspection of survey number 5/6 where the proposed villas are to be constructed. 
Norma Alvares, legal counsel for the tenant association, said they objected to the proposal since there was large scale attempt at defrauding the Tenancy Act. She also questioned the building of the two villas since the tenancy issue had not been resolved. 
An intervening application filed by Floriano Lobo was admitted in PIL writ petition filed in the St Anthony Mundkar and Tenant Association vs Leading Hotels and others case.
In his application, Lobo, referring to a complaint of the fraud by revenue authorities in collusion with vested interests said there was “apparent dishonest making use of fraudulently and illegally framed and maintained Record of Rights in extract Form I and XIV.” He also attached an annexure of a letter from Advocate Andre Antonio Pereira to the Chief Secretary of land grabbing.
The association had last year filed a PIL as tenants of the land and also asked for an interim stay on the project. In their application, they said they were actively involved in agriculture on the lands and were earning agricultural income from cultivation including paddy cultivation and horticulture.
Later, Goa Foundation, one of the petitioners asked for an interim stay on the project after Leading Hotels began cutting trees in the village. The situation in the village grew tense with the presence of some 50 bouncers.
The situation a few weeks later grew tense as villagers clashed with the bouncers and developer officials.
