PANJIM: The North Goa Sessions Court, Panjim granted conditional bail to Javiton Edmund D’Souza of Tivim, who was arrested by the Colvale police on the charge of killing his father-in-law in June this year.
The Court stated that D’Souza be released on personal bond of Rs 50,000 with one surety in the like amount. He has been asked not to tamper with the evidence or witnesses and to remain present in the Court and before the police as andwhen directed.
The accused has also been directed not to leave the State without the prior permission of the Investigating officer and the Court.
The Colvale police had arrested D’Souza on June 4, 2023 and was presently remanded in judicial custody. Arguing on behalf of the accused, Adv Vinayak Porob told the Court that the applicant was innocent and has been falsely implicated in the case and was arbitrarily arrested on June 4, and since then he was in the custody.
He said that D’Souza will not tamper with any of the witness or evidence and that he is also willing to cooperate with the police in the investigation.
Opposing the bail, the Colvale police stated that deceased Denise Dias was having grudges against the suspected accused as the latter was staying in the house of the deceased at Cansa-Tivim. On the night of June 3, Dias returned home under the influence of alcohol and started abusing the accused and his wife with filthy words. In a fit of anger, the accused allegedly assaulted the deceased with slaps and kicks causing bodily injuries resulting in death. The police also produced supplementary statement of deceased’s wife who stated that her son-in-law was responsible for committing murder of her husband and prayed that the bail application be dismissed.
Sessions Judge Sherin Paul in her order observed that that the assault was in a fit of rage because of the continuous abuses and that it does not appear that there was any premeditation and an intention to kill.
“The manner in which the incident took place is only for the purpose of deciding this application and is not to be considered at the time of deciding the case on merits after recording evidence,” the Judge said.
