PANJIM: Goa Lokayukta Justice P K Misra has asked the Anti-Corruption Branch (ACB) of Goa Police to explain why an FIR was not registered against Cumbharjua MLA Pandurang Madkaikar in the disproportionate assets case filed by Adv Aires Rodrigues in May 2018.
Adv Rodrigues had filed a complaint with the Lokayukta over the inaction of the ACB in probing the complaint against Madkaikar, on June 7 last year.
In his complaint, Adv Rodrigues had pointed out that Madkaikar on April 1, 2018 inaugurated a huge palacial bungalow at Old Goa estimated to have cost around a whopping Rs 200 crore. He had demanded that the ACB register an FIR under Sections 13(1) (d) & (e) of the Prevention of Corruption Act 1988 and Section 120-B of Indian Penal Code against Madkaikar and his wife Janita Madkaikar, the Sarpanch of Old Goa and to investigate the disproportionate assets.
In his complaint, Adv Rodrigues had drawn the attention of the ACB that in his income-tax returns for the financial year 2015-16, Madkaikar had shown his total income for the year as a mere Rs 1,44,389 and that of his wife Janita, a paltry sum of Rs 24,389. He also informed that Madkaikar has shown total liabilities including wife Janita’s to the tune of more than Rs 21 lakh.
Adv Rodrigues had stated that on perusal of the affidavit of the assets and liabilities filed by Madkaikar during the 2017 Assembly polls, clearly reveals that the construction of the new palacial bungalow at Old Goa was clearly disproportionate to the known source of income of Madkaikar and his wife Janita.
After hearing the arguments, Justice Misra has reserved his order on whether to conduct a detailed investigation or not in the alleged disproportionate assets case.
