Why NSA? Asks legal fraternity

Goa’s legal eagles have come down heavily on the decision to invoke the National Security Act (NSA) for three months in the South Goa District even as the Chief Minister’s Office (CMO) clarified that it was a routine order

The extension or renewal of applicability of NSA to South Goa amounts to an admission by the government of its failure to enforce an order under normal laws. The government has to first explain the reason for this failure. Is it because of too much interference with the police by the powers that be? This extension will have to be read also with the government’s move to curtail Twitter and other social media outlets. Obviously, the government is rattled by the incessant criticism it faces on all fronts and instead of meeting it, head-on is seeking to suppress it through draconian measures.

It is not applied to anything but it is giving powers to the District Collector and it appears that the government is doing this as a routine exercise, after every three months. Only this time it has come out in public domain. Otherwise, such notifications are routinely issued. There may be an intention behind the notification but this has been done for a very long period of time.

Invoking NSA looks like a political move to subdue any movement that would affect the government. It is very simple to say about invoking the NSA and keeping someone in jail. Getting bail under the NSA is not that easy. Over a period of time, NSA has been misused rather than put to right use. 

However, we should right now believe that NSA is invoked with the intention to use it rightfully, but considering the situation in South Goa where there does not seem to be any criminal activity by any individual, it is not normal to invoke NSA. The intention seems very deviate.

Any order under the NSA is for the purpose of an emergent situation. How does the emergency work? Issue order of June 8, 2021 and publish it on June 17, 2021. That too in Series II? Also, the issuance of such an Order – is it an admission that BJP-led Goa government has lost control over law and order in the State.
