PANJIM: Former president of Goa Government Employees Association (GGEA) John Nazareth on Tuesday said that he will file a complaint before the Vigilance Department against Institute of Psychiatry and Human Behaviour (IPHB) Deputy Director, Dr Pooja Madkaikar for misrepresentation of Supreme Court judgment to protect an unqualified staff working in the institute.
Nazareth said that Dr Madkaikar has knowingly or unknowingly indulged in indiscipline by trying to misinterpret the judgment of the Supreme Court and acted in a manner of unbecoming of a government servant and abettor in criminal acts of the alleged unqualified staff Satish Naik.
Nazareth said that Dr Madkaikar should note that the Supreme Court in the judgment in the District Collector Vizinagaram vs M Tripura Sundari Devi has observed, “It may be realised by all the concerned that when advertisement mentions a particular qualification and an appointment is made in disregard of the same, it is not a matter only between the appointing authority and the appointee concerned. The aggrieved are all those who had similar or better qualifications than the appointee or appointees but who had not applied for the post because they did not possess the qualifications mentioned in the advertisement. It amounts to a fraud on public to appoint a person with inferior qualifications in such circumstances unless it is clearly stated that the qualifications are relaxable. No Court should be a party in the perpetuation of fraudulent practice.”
