Upto 400 sq mts encroached, but it’s legal now, says Parulekar

Q: When did you purchase the property from Serula Communidade?

DP: I legally purchased that property which came in my name in the year 2014 but since the year 1990, the same property was leased to me by Communidade. I have obtained an NOC to erect a wooden pole with tin sheets to construct a kiosk. Since then I have my business. As business started flourishing, I felt the need for more space. Sharing a good rapport with the committee of Communidade, I gradually encroached up to 400 sq mtrs. Meanwhile, I was served with a demolition notice but the court has set aside the order in the year 2010 after 66 months of court case.
Q: Now the property is in your name? Have you purchased it?
DP: Yes, after complying with all the procedures needed under communidade rules, they sold that property to me. I have a clear title now, with mutation of the property and even on forms I & XIV my name has been put. There is an order of administrative tribunal to hand over the 599 sq mtrs of land to me.
Q: So you claim there are no illegalities in the said land deal?
DP: No, even the high court has passed an order and said that the land should be regularized following due procedures in accordance with the law. There is a huge difference between value of private land and Communidade land.
Q: How much money you paid to purchase the property and is it justified with the present land price in that particular area?
DP: I have paid around Rs 7.5 lakh. After the HC order to verify the prices of the said plot, it has been found by the Communidade that I have paid above the price of 
the Communidade. Now they have to return at least 2 lakh to me. The file is with the 
collector for final 
settlement.
Q: How you own another two shops under the rehabilitation whereas you have your existing structure intact in survey number 376/6?
DP: One shop I received as compensation for road widening and the other I have legally purchased. My kiosk also existed along with other eight kiosks.
Q: Have you been to the crime branch for deposition?
DP: Yes, my statement was recorded at the crime branch in Ribandar. I have given my say and handed over all the legal documents and files to them.
Q: If you own the property, why has it not been declared in your last two affidavits to the election commission of India?
DP: In 2007, as I have said, it was leased to me. Even in the year 2012, it was same. I became the rightful owner only in the year 2014. However I have still mentioned in my 2012 affidavit about this leased 
land.
