The Goa State Information Commission in an order has directed the office of the Registrar of Cooperative Societies, here, to furnish the missing XVIIth inspection report of the Reserve Bank of India pertaining to Goa Urban Cooperative Bank Limited, here, which was sought by Adv Rui Ferreira of Panjim.
The order of the GSIC has taken serious note of the missing document and has further directed the office of the RCS to fix the responsibility and initiate action against the delinquent officer/officials by lodging FIR and suitable penalisation. The same be done as early as possible and report compliance, the order states.
It reads further, “Issue notice under section 20(1) of the Right to Information Act to the Public Information Officer at RCS (D S Morajkar) why penal action should not be taken against him for causing delay in furnishing the information. The explanation, if any, should reach the Commission on or before October 8, 2010.” The PIO has been directed to attend the hearing on the said day.
Adv Ferreira on April 3, 2009 had asked the office of the RCS for two documents – XVIth and XVIIth inspection reports of RBI – to know whether the Banking Regulations Act was followed while preparing these documents.
After the RCS failed to furnish him the reports Adv Ferreira approached the GSIC on August 21, 2009. The RCS replied to the Commission stating the documents were not available.
On November 13, 2009, not satisfied with the reply of the RCS, the Commission remanded the matter back to RCS asking them to furnish the reports to the applicant. This time, The RCS maintained the reports were confidential.
Adv Ferreira again filed a complaint before the Commission on February 10, 2010. But the RCS kept on maintaining before the Commission the reports were confidential. Finally, on June 14, 2010 in its first order the Commission directed the RCS to furnish the information to the applicant.
After the first order RCS furnished the XVIth inspection report of RBI to the applicant, but failed to give him the XVIIth report. It maintained the said report was not traceable. In July, this year, Adv Ferreira again filed a complaint before the Commission bringing to notice non-compliance of its order by RCS.
The Commission has now posted the matter to October 10, 2010 to see whether RCS has complied with its order.
