MARGAO: The Administrator of South Goa Comunidades has issued a 15-days notice to the illegal occupants of the Pedamol land to either vacate or face action.
In an order disposing the proceedings under Article 371 (2) read with Art 372 of the Code of Comunidades, the administrator directed the encroaching parties to vacate the encroached land within 15 days from the date of receipt of the order.
The administrator also warned that in case the opponents failed to comply with the order by removing the encroachments, then, the same would be removed by him without giving any further notice and the cost incurred would be recovered from them as arrears of land revenue under Land Revenue Code 1968.
The administrator has also said in his order that the opponents were earlier given an opportunity to produce all documents in support of their case along with reply to the notice.
The replies received from the encroaching parties were ‘nil’ which meant they could not produce any satisfactory reply to back their illegal act.
“The opponent has not produced any documents to substantiate property/ownership rights over the property. The occupation of the said property is therefore illegal and amounts to encroachment and criminal trespass over the property bearing survey No.88/1, of village Sirvoi, belonging to the Comunidade of Sirvoi,” the notice read.
The Comunidade of South Goa had been sitting over the complaint of the land grab since 2012 and finally after a delay of over five years the Comunidade administrator has finally issued the orders against the illegal construction at the Pedamol Comunidade land.
Now that the administrator is clear that it is a criminal trespass on the comunidade property the demand for filing a criminal case against the Attorney of the Comunidade and the involved staff and members of the comunidade is gaining grounds.
A Quepem villager said it was a fit case for criminal proceedings against the land grabbers and the Attorney and Escrivaos from those areas of land grab have to be inquired upon as they have surely got disproportionate assets to prove they were facilitators of this land grab.
“Why isn’t the attorney of Shirvoi Comunidade being put in the dock for all these illegalities charged of the criminal trespass and filed a police complaint against to put him in the dock for equality of justice?” is the question being raised by many.
