Surety Viola directed to produce absconding convict

MARGAO: Margao JMFC Pooja Kavlekar on Tuesday extended the warrant against convicted MLA Francisco Mickky Pacheco by seven days and issued notice to Mickky’s surety Viola Pacheco to produce the absconding convict in the court.
The JMFC has also underlined some vital steps which the police have failed to follow in the investigation. However, the Investigating Officer Uttam Raut Dessai has yet again in the detailed action taken report failed to establish any confirmed whereabouts of the convicted MLA Mickky Pacheco.
JMFC Pooja Kavlekar on Tuesday has refused to issue proclamation against Pacheco. The JMFC said, “There is a surety bond submitted in a previous Court proceedings, hence proclamation cannot be issued against the convict until the surety is forfeited.” The JMFC also advised the investigating officer to find the notary in Delhi who certified the copies of the application which Mickky moved in the Supreme Court recently as he can give valuable information to them. When asked whether Mickky has absconded from Delhi, the IO said he should be in Delhi, but don’t know whether he is absconded from Delhi.
Adv Aires Rodrigues has claimed that the close accomplice of Mickky, Lyndon Monteiro has travelled four times to Delhi in the last week and he holds the key of this investigation.
The JMFC on Tuesday also pointed out to the Special Public Prosecutor Suresh Amonkar that according to a High Court circular, the High Court doesn’t permit judges to hear from advocates under whom they have worked with in the past. The Special Public Prosecutor has been advised to produce an order by the Government after which the judge will recuse herself from the hearings.
On the search warrant on 10, Akbar Road, the JMFC said ‘let the appellate Court decide the matter.’
