MARGAO: Additional Sessions Judge Saynora Teles Lad adjourned the case against Vikat Bhagat for orders on the application filed by his father to release his scooter that has been seized by the police and is in their custody for the last 10 months.
Vikat’s father Surendra who is the owner of the scooter was represented by Adv S Desai who on Friday argued that since he is the legal owner of the scooter it should be returned to him.
However, Public Prosecutor V G Costa vehemently argued against the application stating that if the scooter is released to the applicant it would result in his case being totally destroyed as there was every possibility of the vehicle being tampered with and the evidence on the scooter like the blood stains there be removed.
He also pointed out that the pancha witnesses have not yet been examined and it would be premature to release the scooter to the applicant at this stage.
Adv A Moniz representing the accused Vikat Bhagat argued that the scooter was a mere mechanical instrument that would deteriorate with time. Besides, she said the reports from the Central Forensic Laboratory have already come.
While giving her no objection to releasing the scooter she said that the court could laid down some conditions like the look of the vehicle should not be changed and it should be produced in the court as and when required.
