PANJIM: The Goa Industrial Development (Amendment) Bill, 2015, which proposes increase in penalty for construction or use of land and buildings contrary to terms of building was tabled in the Goa Legislative Assembly on Wednesday.
The Amendment to the Section 33 (1), (2) of Goa Industries Development Act, 1965, tabled by Industries Minister Mahadev Naik proposes to penalize any person who undertakes or carries out construction or alterations to buildings in an industrial estate or industrial area contrary to the terms under which he holds such building or land under the Act or any rules. On conviction the person can be fined up to Rs 1 lakh, which is at present Rs 10,000.
It further says that in case of a continuing contravention with a further fine which may extend to Rs 5000 for every day during which the offence continues after conviction, which was currently Rs 500.
The Bill also proposes penalty for any person who uses land in a building in an industrial estate or industrial area contrary to the terms under which he holds such land or building under the Act or rules or in contravention of the provisions of any regulation. On conviction, he can be punished with a fine which may extend to Rs 50000, which is currently Rs 5000.
The Bill also proposes an amendment to the Section 37 B on development of areas, which proposes a committee consisting of GIDC MD as chairperson, Under Secretary (Revenue), one member nominated by the corporation from amongst the directors of the corporations having knowledge in the field of engineering, architecture, industry, and an officer of rank of Dy Town Planner nominated by the government as a member secretary.
The committee, according to the Bill, will decide and dispose of all applications for land permissions, no objection certificate, construction of building under local or special laws including Goa Daman and Diu Town and Country Planning Act, 1974 (Act 21 of 1975) and rules.
