MARGAO, APRIL 26 (HR) — The South Goa Sessions court on Monday heard arguments in the revision application filed by Russian woman rape accused John Fernandes.
After hearing the arguments, the court has reserved the orders to April 29. John’s legal counsel, Adv Mike Mehta said the JMFC, Margao allegedly did not comply with the provision of section 207 of the Cr P C before he committed John’s matter to the sessions court for trial.
He argued that the JMFC had declined to grant his prayer seeking extracts of the police station diary. Incidentally, Adv Mehta said he has obtained the extracts of the station diary through the Right to Information (RTI) Act.
Adv Mehta submitted before the court that the JMFC did not comply with the mandatory provision of hearing the accused before committing the order to the Sessions Court for trial and prayed that the matter be reverted back to the lower court.
