Builder’s appeal against conviction dismissed, sent to jail

PANJIM: The Sessions Court dismissed the appeal filed by proprietor of Prabhu Constructions in the cheque dishonour case and confirmed the Judgment of the Magistrate convicting the accused and sentencing him to undergo rigorous imprisonment for a period of six months. 

He has also been ordered to pay compensation of Rs 2.14 crore to the complainant and in default to undergo simple imprisonment for a further period of six months.

The Sessions Court Judge Sherin Paul after hearing arguments in the appeal has passed the order of confirming the sentence ordered by the Judicial Magistrate First Class of Panjim. 

It may be recalled that the appellant was convicted by the Judicial Magistrate Panjim for the offence punishable under Section 138 of the Negotiable Instruments Act and accordingly sentenced him to rigorous imprisonment for a period of six months in year 2022 in a case filed against him in 2019.
