Consumer Forum directs vehicle dealer to pay compensation to consumer

Margao: The Consumer Disputes Redressal Forum, South Goa has directed the dealer and manufacturer of Jeep Compass to pay Rs 50,000 as compensation and interest on the amount paid by musician Tertuliano Darryl Gomes while booking the Jeep vehicle in September 2018.
As Tertuliano decided to purchase a four-wheeler to transport his equipment, he made a visit to M/s Quadros Motors Pvt Ltd and paid the booking amount of Rs 50,000 on September 8, 2018 to purchase the vehicle Jeep Compass. However, as he was told that if he paid the entire amount the vehicle would be delivered within 14 days, Tertuliano took a loan of Rs 12 lakh and using his own funds paid the balance amount of Rs 17 lakh as the entire price of the vehicle on October 5, 2018, stated a press release.
However, the company failed to deliver the vehicle even though the complainant had to pay the monthly instalment on the loan he had taken to pay the entire amount.
In its reply, Quadros Motors mentioned they had never promised to deliver the vehicle within 14 days and had in fact told the complainant that the waiting period was around six months as there was great demand for the vehicle.
The manufacturers of the vehicle M/s Jeep Automobiles Pvt Ltd while admitting that Quadros Motors was their dealer, however, argued that the agreement was between the dealer and the complainant and they had not role to play in it.
In its order Consumer Disputes Redressal Forum rejected Quadros Motors claim that they had not promised to deliver the vehicle within 14 days and pointed out that in one e-mail the company official had assured Tertuliano that his vehicle would be delivered within 14 days.
