The City Fast Track Court sentenced a youth to ten years rigorous imprisonment on the charge of raping a 60-year-old woman on the night of December 28, 2008.
The Fast Track Court held a native of Hyderabad, Mohammad Alif Laila, guilty of rape and threat charges. As per the case of the prosecution accused raped the victim while she slept in the Panjim fish market on December 28 night and later threatened her of dire consequences if she revealed his identity.
However, he was arrested immediately the next day when the complaint came to be filed. The prosecution examined 21 witnesses in support of the case but stable deposition of the victim and positive DNA report proved important in convicting the accused.
The Court said the prosecution has proved beyond reasonable doubt that the accused committed the offense. The Fast Track Court Judge Vijaya D Pol observed that , “In this case not only the testimony of the victim inspires confidence and is fully reliable and remained unshaken in the cross examination but also medical reports and CFSL report further fortify her testimony.”
In addition to ten years imprisonment, accused has been fined to pay Rs 10,000. Furthermore, he has to undergo one month rigorous imprisonment and pay fine Rs 500 on the charge of threat.
In default, he will have to undergo further imprisonment of six months. But since he has been in judicial custody from his arrest in December end 2008 the Court ordered that a period of sentence be set-off against detention he has already undergone. The State was represented by Public prosecutor M Pinto and the case was conducted by PSI Tushar Vernekar attached to town police station.
