Locals stop construction at Devabhag

CANACONA: Around 50 persons went to the construction site of Bharat Developers at Devabhag, Canacona on Tuesday and stopped work alleging illegality in the construction. 
In this connection, the Chief Officer of the Canacona Municipality, Amul Gaonkar, had asked the owners of the Company, Pardip Birring and Jagdish Sehghal, on Thursday, June 16, 2016 to submit all the required documents as per the Goa Land Development and Building Constructions Regulation 2010, within seven days.
The chief officer’s letter had mentioned that the construction licence had expired and that relevant documents were not provided in the application for the renewal.
After the tragic collapse of the Canacona Ruby Residency two years back on January 4, 2014, Bharat Developers and Realtors Private Limited have resumed construction of their two pending projects at Nagarcem and at Devabhag by hiring a new contractor. This prompted the mob to go and stop work at the construction site at Devabhag.
Speaking to Herald, the former director of the firm Pardip Birring said that the construction licences of the two other projects had been restored after getting the order from Administrative Tribunal. 
He said they had now officially applied to the Canacona Municipality for restoration of its construction licences.
He said that the Administrative Tribunal set aside the order suspending the licences to the builder, stating that the grounds, on which suspension has been made, were unreasonable and unfair.
Based on the Administrative Order, the builder had applied to Chief Officer of the Canacona Municipality on March 8, seeking to restore the construction licences. However, the chief officer replied that the council didn’t have the files of the builder. Since the chief officer failed in its reply for the second time in April 2016, therefore the Bharat Developers deemed permission to resume construction, considering it has a right to resume its work after the municipal council failed for 60 days to grant permission, as per Section 184 (6) of the Goa Municipality Act.
“We are not responsible for the collapse of the Ruby Residency but the contractor is. We have filed a recovery suit for damages, losses and compensation against Vishwas Desai for Rs 27 crore. The agreement clearly mentions the contractor’s liability and the quality of the material to be used,” said Birring after handing over the agreement copies.
Meanwhile, one Rajesh D Desai of Kindlem, Canacona has complained against the builders to the Chief officer of the CMC  to stop the illegal construction at Devabhag at Survey number 163/1, Chawdi, Canacona.
Over the letter, the Chief Officer requested Rajesh Desai wide letter no-681, dated May 31, 2016 to remain present on the site for joint inspection (with Municipality Engineer, Jugdip Sehgal and Pardip Birring) on June 9 and 21, 2016 respectively. However, the concerned Chief Officer Amul Gaonkar remained absent on both the days. This forced the mob to stop the construction work since the people threatened the builders with dire consequences it is learnt.
“We will compensate victims of the families,” Pardip Birring said when Herald inquired about the past tragedy.
