PANJIM: The Court of the Judicial Magistrate First Class (JMFC) Mapusa issued a show cause notice to Porvorim PI Anant Gaonkar for not registering a First Information Report (FIR) in a murder case inspite of a court order directing him to do so.
The JMFC court had directed the Porvorim police to register a murder offence in a case of death that had occurred at Penha de Franca Britona in January 2022 .
The show cause notice was issued after the applicant, Melcy Pinto, the daughter of the deceased Nicolau Pinto filed a contempt petition before the JMFC against the PI for violating the court and not registering the FIR in the case.
A show cause notice has been issued to PI Porvorim under Contempt of Court Act asking explanation for the disobedience of the order of the court directing investigation.
Complainant Melcy Pinto had appealed before the JMFC Mapusa for registration FIR in the case of the death of her father Nicolau Pinto, 59 who died on January 3, 2022 in Britona, Porvorim allegedly under suspicious circumstances.
The Porvorim police had registered a case of unnatural death. Later on August 5, 2022, Melcy filed a complaint alleging foul play into the death of her father against Liao Vaz, Flasten Martins, Esabel Rego and others. After the Porvorim police failed to register the FIR, the complainant approached the Judicial Magistrate First Class (JMFC) seeking directions for registration of her complaint under section 302 (6), 448 and 201 of IPC. Adv Vinayak Porob appeared for the complainant.
The Court after hearing the application had recently observed that a cognisable offence is made out in the case and later directed the Porvorim Police to register an FIR and investigate into the complaint.
