SC stays demolition of Curlies property, next hearing on sept 16

New Delhi: The Supreme Court in its order on Friday said structures in existence in lands other than survey number 42/10 are not covered by the width of this order. “Resultantly, if there be any unauthorised construction in lands other than survey number 42/10, the demolition can certainly go on,” it said.

The Court also stayed the demolition of the structures standing on survey number 42/10, “subject to the appellant not undertaking any commercial activity in or with respect to the said structure”.

Arguing on behalf of the petitioner Linet Nunes, senior advocate Huzefa Ahmadi referred to certain documents to show that the structure in Survey No 42/10 was in existence prior to the year 1991 and that his clients own only property at this survey and other structures do not belong to her.

Adv Abhay Anil Anturkar accepted the notice on behalf of the Goa Coastal Zone Management Authority (GCZMA), assuring to file a response on or before September 14 in the matter with pictures and plans. 

Adv Aturkar brought on record that he has already sent an appropriate message to the Member Secretary of GCZMA.

The Court issued a notice returnable on September 16.
