Special Mamlatdars for pending mundkar, tenancy cases

The District Collectors will have to ensure that the final judgment and orders are delivered by the revenue court within a period of 30 days from the date of hearing of the final arguments, and filing of written arguments.

PANJIM: With an aim to dispose of all the pending mundkar and tenancy cases within a period of one year, the State government has ordered the District Collectors to designate special Mamlatdars to exclusively deal with these revenue cases. 

In a series of directions issued, Revenue Secretary Sandeep Gawade has made it mandatory for the designated Mamlatdars to hold revenue courts on Saturdays for timely disposal of the cases. 

Also, the revenue cases, which are pending for more than three years, would be disposed of by holding a day-to-day hearing. The Additional Collectors will have to submit a weekly report on the status of cases to the Revenue Secretary. 

Close to 4,500 cases filed under Goa, Daman and Diu Agricultural Tenancy Act, 1964 and the Goa, Daman and Diu Mundkars (Protection from Eviction) Act, 1975 are pending in various revenue courts for the last 10 to 15 years. 

Gawade said that Revenue Minister Atanasio Monserrate has taken serious note of pendency cases and has assured the State Legislative Assembly to take up steps for their speedy disposal. 

“Both the District Collectors shall designate special Mamlatdars who shall exclusively deal with mundkar and tenancy court matters and who shall ensure that hearing of revenue courts should mandatorily happen once date is fixed,” the department said adding that cases can be also handed over to the Mamlatdar in Collectorate offices to ensure fast disposal of cases. 

The department has made it clear that no more than three adjournments in any particular case should be granted till its final disposal and the next date of hearing fixed should not ordinarily be exceeding 10 days.

“The Revenue Officers will have to ensure that in the case due to prefixed engagement if hearing on any particular date will require to be adjourned then prior intimation to both the parties and, or their advocate on record shall be invariably given by way of SMS on their registered mobile number to avoid inconvenience and harassment to the public,” the department said.
