The Ministry of External Affairs’ (MEA) recent clarification that an Indian passport is primarily a travel document and not conclusive proof of citizenship has sparked widespread discussion across the country. The issue gained attention after Rajya Sabha MP Kapil Sibal questioned what documents Indians can rely on as proof of citizenship if a passport does not serve that purpose.While passports are among the most important documents held by Indian citizens, experts point out that their legal role is often misunderstood. Former Indian diplomat Veena Sikri explained that citizenship matters fall under the jurisdiction of the Ministry of Home Affairs (MHA), not the MEA. The MHA is responsible for framing citizenship rules and determining who qualifies as an Indian citizen under the law.According to Sikri, a passport functions primarily as a travel document that enables international movement and identifies the holder’s nationality abroad.
It confirms that the Government of India has issued the document after conducting necessary verification procedures, including checks related to identity, address and police records.However, a passport does not independently grant citizenship. Citizenship is a legal status acquired through birth, descent, registration, naturalisation or other provisions under Indian law. Therefore, the existence of a passport alone does not create citizenship rights.Experts note that passports can also be cancelled if obtained through fraudulent means, highlighting the distinction between passport issuance and citizenship determination.
