MARGAO: The High Court of Bombay at Goa on Friday dismissed the appeal filed by owners of the Verda Resort against the Carmona Panchayat and Carmona Villagers Social and Welfare Forum.
The dismissal of their appeals means, the owners will not be able to use their premises for commercial purpose.
It may be recalled that initially the Carmona Panchayat had issued a construction licence for residential premises at Olvado in the village, but once the construction was completed hoardings were put up indicating that it was a hotel.
People were objecting to the hotel in a residential area, as there was too much of noise from the hotel.
When the owners asked for renewal of their trade licence, the panchayat asked them to produce any document that empowered them to change the residential purpose construction to be used for commercial purpose.
Verda owners then filed a petition before the BDO challenging the panchayat’s directive and got a favourable order. However, the panchayat challenged the BDO order before the Sessions Court that upheld the appeal. Verda owners then filed an appeal before the High Court.
