PANJIM, SEPT 6
A government primary teacher has challenged her transfer before the High Court claiming that the transfer was to accommodate headmaster’s wife.
In a Writ Petition filed before Bombay High Court at Goa, Sujata Kakule from Calangute has stated that being a science teacher her transfer from government high school Betim to Mulgao high school as mathematics teacher is illegal, arbitrary and was pre-planned at the behest of one Rima Zingde and her headmaster husband Shailesh Zingde.
The Division Bench comprising of Justice D G Karnik and Justice F M Reis has directed the Education Department to submit the detail transfer report before the court by next week.
Kakule was appointed as science teacher by the state education department in 1986 and since then, for last 24 years she has been teaching science to standard 6th, 9th and 10th at Betim.
“On July 7, 2010 at around 10.30, Rima came to my school with relieving order and to join as a science teacher here,” petitioner said.
“On the very same day at 12.30 I was served with transfer order dated July 2, transferring me to Mulgao high school,” it added.
However, the petitioner has said that when she joined Mulgao high school she learnt that there is no vacancy for science teacher. “The petitioner was forced to teach mathematics subject for which, she does not have any educational qualification or experience,” the petition stated.
Kakule alleged that Rima, who is wife of Shailesh Zingde, headmaster of Betim high school, was appointed as assistant teacher in December 2009 and within seven months she is transferred to a high school, against Goa board rules.
The petitioner submitted that as per the state government order dated June 26, 2008 and the order passed by Goa Board of Secondary and High Secondary education on February 2, 2010 one teacher can be transferred only after considering the subject handled by such teachers.
“Her husband is quite influential in the Education Department and by using his influence he has got Rima transferred in his school,” Kakule alleged.
The petitioner told Court that she cannot be forced to teach mathematics only because Rima has to be brought to government high school.
