PANJIM: July 15, 2006: Mickky Pacheco assaulted Electricity Department Junior Engineer Kapil Natekar for not attending to a call relating to a power failure in Pacheco’s Benaulim constituency.
A complaint was filed by the JE and later a chargesheet. Margao Judicial Magistrate First Class (JMFC) D. M. Kerkar convicted Mickky under Section 353 of the Indian Penal Code sentencing him to simple imprisonment for one year with a fine of Rs 5,000. Pacheco challenged the order before South Goa Assistant Sessions judge Irshad Aga. But in an order on October 5, 2011 the court upheld the conviction, however reducing the sentence of imprisonment to six months and the fine to Rs 1,500.
Later, Margao Additional Sessions Court judge Vijaya Pol on December 13, 2012, convicted Pacheco for hurting the JE under Section 323 of IPC and released Mickky on an admonition by granting him benefit under Probation of Offenders Act.
Pacheco went in appeal against the conviction and was granted a temporary stay by the SC on July 30, 2014. However the Supreme Court later vacated the stay and the conviction was upheld.
Mickky appealed for reduction of sentence at the Supreme Court, and meanwhile the JMFC Margao issued arrest warrants against Mickky.
After four to five successive failures of police to nab Mickky, on the 6th of May he was proclaimed as an offender and declared an absconder by the judicial Magistrate First Class. The review petition filed by Mickky was also dismissed by the Supreme Court.
Team of Police was still in Delhi searching for Mickky while both the prayer of advocate Aires Rodrigues for monitoring of case by court and the warrant issued for search at 10, Akbar Road were dismissed and quashed.
Four days after the last order of the Additional Sessions Court over the search at 10 Akbar Road, Mickky Pacheco finally surrendered before the JMFC.
