Pressing for the framing of charges under the Unlawful Activities (Prevention) Act, Explosive Substances Act and for waging a war against the state, the National Investigation Agency has said the accused arrested in the Margao bomb blast case had hatched a conspiracy to create terror in the minds of viewers, organizers and participants of Narkashur Competitions since the government did not respond to the Sanatan Sanstha demand for a ban on Narkashur competitions.
Special Public Prosecution, S B Faria made the submission before Sessions Judge U V Bakre on Wednesday during a marathon two hour long hearing of arguments before framing of charges against the accused persons.
Faria said Malgonda Patil and Yogesh Naik were linked to the Sanatan Ashram, adding that investigations have established that Malgonda Patil was staying in a room along with other Sadaks for the last four years.
He submitted that in furtherance of the conspiracy, the accused persons Malgonda Patil and Yogesh Naik carried Improvised Explosive Devises in the dickey of Enterno scooter to carry out subversive activities of sabotage at the Narkasur competition at Margao to create terror in the viewers, organizers and participants
He submitted that the Sanatan Sadaks wanted the government to either ban Narkasur competitions or prevent the organizers from organizing the competitions in such a fashion showing Lord Krishna in poor light.
Making his submissions, Faria said investigations further revealed that all the accused persons hatched a criminal conspiracy at the house of Laksmi Naik, brother of Yogesh Naik at Talaulim-Ponda. In fact, Faria said that accused Vinay Talekar pointed out the place wherein he and Yogesh Naik allegedly prepared gelatin/slurry bomb (IED) in the month of August 2009.
He said accused Dhananjay Ashtekar was in contact with co-accused Malgonda Patil on or before October 16, the day of the incident, adding that Asthekar has disclosed in the presence of independent witnesses and on the basis of his statment, recovered electronic items and accessories, which were used in the preparation of IEDs.
The special public prosecutor further said that the first test blast was conducted at the hillock behind the house of Laxmikant Naik at Talaulim, Ponda during the last week of August 2009 at the instance of accused Dilip Mangaonkar.
Faria told the Court that the prosecution has evidence that the accused prepared the IEDs and conducted test blasts at the hillock behind the residence of Laxmikanth Naik on August 26, 27 and 28 and thereafter conducted a second test blast at Jath Sangli, Maharashtra during the last week of September 2009.
The Prosecutor brought on records the statements of various witnesses in support of its case.
Judge Bakre later adjourned the hearing to June 18, where Faria would resume his arguments, before the defense counsel advances his arguments the same day.
Faria later told newsmen that the NIA would impress upon the court to reject the bail applications filed by accused Vinay Talekar, Vinayak Patil and Dilip Mangonkar when arguments before framing of charge resumes on Friday.
