PANJIM: The High Court of Bombay at Goa has issued a notice to the Goa Coastal Zone Management Authority (GCZMA) member secretary Parag Nagarshekar in a contempt petition filed by a senior citizen for non-consideration of his application for undertaking reconstruction in his property, despite assurance before the Court, almost ten months back.
The Division Bench comprising of Justice Prthviraj Chavan and Justice N M Jamdar has the issued notice to Nagarshekar returnable by June 19. The Court is also contemplating a disciplinary action against the Member Secretary for non-performance of public duty.
One Caetano Jose Fernandes had moved the High Court with a contempt petition against the Member Secretary for failing to consider his application for reconstruction of his residential house in December 2015.
Since it was not decided, a Writ Petition was filed by Fernandes, which was disposed of on September 18, 2017 on a statement that the application would be considered within six weeks. Till date, the application has not been decided.
The Division bench, while issuing the notice observed that the three years period for consideration of the application for reconstruction of his residential house cannot be considered as reasonable by any administrative standards.
“Non-consideration of the application is not only breach of the order but shows non-performance of public duties, for which a disciplinary action is also contemplated,” Court said.
