Rights panel issues notice to Collector over mutation delay

MARGAO: The Goa Human Rights Commission has issued notices to the district Collector, South, deputy collector (Revenue), Margao, besides the Joint Mamlatdar-I and Secretary, Revenue in connection with the complaint of harassment filed by a resident of Per-Seraulim vis-à-vis huge delay in carrying out mutation of her property.
The Commission has directed the Collector, the deputy Collector and the Jt Mamlatdar, Salcete to appear before the panel on June 19 in person or through a lawyer. The commission has threatened to proceed to take such action as it deems proper if the officials fails to attend the hearing.
In her complaint, Betty stated that though the Revenue rules mandates the authorities to carry out mutation within 30 days, the Salcete Mamlatdar office has not carried out the mutation even after making 100 trips to the office since the last eight months.
She pointed out that the authorities have unnecessarily delayed the mutation by raking up the question whether Persons of Indian Origin (PIO’s) and Overseas Citizens of India (OCI) can transfer land to resident Indians. 
“I had submitted all the circulars governing the aspect of OCI, PIO’s and foreign nationals, as well as RBI guidelines pertaining to the acquisition and transfer of immovable property in India, by person residing outside India, to the Joint Mamlatdar-I, which entitles me to get my name mutated in the survey records of the property,” Betty had stated in her petition before the Human Rights panel.
In her petition, Betty has contended that the Joint Mamlatdar has not cited any rule that Indian National cannot buy property from OCI/PIO without conversion, adding that any conversion is done only after mutation. She has demanded to know whether the Mamlatdar has powers to revoke the sale deed done by the Sub Registrar by proving that such a deed is invalid and therefore rejected for mutation.
