PANJIM: Almost two months, during which Pernem police failed to file an FIR in the “abetment to suicide” complaint against Water Resources Minister Dayanand Mandrekar, and his son Samir, Priya Mitbowkar has now approached the court for justice.
Priya, widow of Nilesh Mitbowkar, who committed suicide in November last, approached the JMFC Pernem under Section 156/3 of CrPC, after Pernem Police refused to register a complaint.
In her application, Priya stated, “Samir along with his father Dayanand had been harassing, torturing and pressuring my late husband with the sole intention to evict him and his family from the tenanted property to the extent that he could not take it any further and committed suicide.”
She further stated that Mandrekar, who is a minister and an MLA, had used and is using the entire government machinery to achieve the goal of evicting her and her family from the property.
She said that on December 10, 2015 she had filed a complaint against Mandrekar and his son, a copy of which was given to SP, North, but the police did not even register an FIR against the duo.
She stated that the actions of the police in not registering the offence/FIR under section 107, 306, 503 & 506 (II) r/w 34 of IPC against Mandrekar and his son is an illegal and unlawful act and amounts to dereliction of duty.
She pleaded that the court direct the police to register an FIR under the relevant sections taking into cognizance the allegations made by her and initiate investigation.
