MARGAO: The Principal Sessions Judge B P Deshpande on Thursday issued notices to the South Goa Superintendent of Police and the Fatorda police inspector following an application filed by Adv Aires Rodrigues complaining that the Fatorda police failed to register an FIR against local MLA Vijai Sardesai.
In his complaint, Adv Aires accused Vijai of having hatched a criminal conspiracy and committed cognizable offences under the Indian Penal Code and the Prevention of Corruption Act. The Police have been directed to file their replies on October 13.
In his application filed under Section 156(3) of the Criminal Procedure Code, Adv Aires has sought directions to the Fatorda police to register an FIR against Vijai Sardesai and other unknown persons for offences under Sections 420 read with Sections 511 and 120-B of the IPC (Indian Penal Code) and Sections 7 and 13 of the Prevention of Corruption Act.
Adv Aires’ application seeks directions to the police to probe the case properly and to investigate all persons against whom suspicion is raised and any other material that comes to the fore in the course of investigation. He has further sought that the court monitor the investigation as the accused Vijai Sardesai is politically very influential.
Claiming that the failure of the Fatorda police to register an FIR against Vijai smells of political interference, Adv Aires has also submitted that refusal to register a cognizable offence constitutes a breach of the various judgments of the Supreme Court and also the Bombay High Court.
On September 30, Adv Aires had lodged a complaint at the Fatorda Police Station against Vijai Sardesai and later on October 2 had petitioned the South Goa Superintendent of Police as the police had not registered an FIR.
