PANJIM: The North Goa Sessions Court and Fast Track Special Court (POCSO) granted conditional bail to Mahamedsadiq Badiger of Saligao, who was arrested on the charge of raping a woman.
The Court ordered that Badiger be released upon executing bail bond of Rs 50,000 with one surety in the like amount, he has been asked to remain present before the concerned police station for a period of 15 days from the next day of his release from 10 am to 12 pm and from 3 pm to 5 pm excluding public holidays and Sundays.
He has been asked not to threaten any of the witnesses and the victim and not to tamper with the evidence. The applicant has been asked not to leave the State without the permission of this Court and to surrender his passport in case if he has it.
He has been further asked not to enter within the radius of one kilometre from the house of the victim and to cooperate with the investigating agency.
Arguing on behalf of the applicant, Adv Vinayak Porob said that the applicant was falsely implicated in the crime for the offence punishable under Section 69 of BNS 2023. The accused had allegedly befriended the complainant from September 2024 till date and on the pretext of marrying her had sexual intercourse on number of occasions and ultimately failed to deliver the promise of marrying her.
Adv Porob also relied on the previous judgments wherein Courts found that the victims were married and having children and still continued to with company with the accused.
The Courts found that there was consensual relationship and granted bail to the accused.
Opposing the bail application, the investigating officer PSI Laureen Sequeira told the court that the medical report of the victim was awaited and that statement of many more witnesses were to be recorded. The accused had committed serious offence which had shattered emotions of the victim, who even divorced the husband last year.
However, the Sessions Court said that there was some kind of consensual relationship between both the parties and granted conditional bail to the accused.
