The Allahabad High Court (Lucknow Bench) on Friday observed that allegations regarding dual citizenship against Rahul Gandhi, the Leader of the Opposition in the Lok Sabha, warrant a detailed inquiry. The court directed the Uttar Pradesh Government to either conduct the investigation itself or refer the matter to a central agency.
The directive came while hearing a petition filed by S Vignesh Shishir, a BJP worker, challenging a January 28 order of a special MP/MLA court in Lucknow. The lower court had dismissed his plea seeking registration of an FIR against the Congress leader, stating that it did not have the jurisdiction to decide matters related to citizenship.
The petitioner, a resident of Karnataka, has called for a thorough probe and registration of an FIR, citing alleged violations under multiple laws, including the Bharatiya Nyaya Sanhita, the Official Secrets Act, the Foreigners Act, and the Passport Act.
The High Court’s order effectively revives scrutiny into the allegations, placing the onus on state authorities to ensure an appropriate investigation is carried out in accordance with the law.
