The Fast Track Special Court in Panjim has acquitted a 38-year-old yoga instructor, who was facing charges of alleged rape and cheating involving a foreign woman.
The case stemmed from allegations that Agarwal had sexually assaulted the complainant under the pretext of administering a “Tantric massage” at his yoga centre in Korgao. He was also accused of cheating in connection with the incident.

During the trial, however, the complainant did not appear before the court to depose as a witness. The Investigating Officer informed the court that despite efforts, her presence could not be secured.
In its judgment, the court observed that in the absence of the testimony of the complainant, who was the primary witness in the case, there was insufficient evidence to establish the allegations beyond reasonable doubt. The court further held that an accused cannot be convicted solely on the basis of circumstantial evidence or administrative irregularities when the principal witness has not testified.
Accordingly, the Fast Track Special Court acquitted Agarwal of the charges.
