Rodrigues in his caveat application has sought that he be heard before a order is passed on any petition filed by Pacheco seeking to attend the Assembly session and has sent a copy of the caveat to Pacheco at Sada Jail where he is currently lodged and also to his Betalbatim residence.
Rodrigues stated that he would intervene to oppose any petition by Pacheco seeking to attend the assembly session as the government in connivance with the Nuvem MLA may not place the correct facts before the court.
Pointing out that Pacheco’s current priority should be to complete his six month sentence, Rodrigues stated that his attempt to curtail his time in jail needs to be strongly thwarted.
Stating that Pacheco being an MLA does not entitle him to claim any exception from being in detention, Rodrigues stated that nobody has a more sacred obligation to obey the law than the lawmakers themselves.
He stated that Pacheco, in trying to attend the Assembly session, is seeking respite from imprisonment and that there is no reason to make an exception as he has to be treated like any other prisoner.
Accusing Pacheco of trying every stunt to get fresh air outside the prison walls, Rodrigues has stated that attending the Assembly Legislative session was neither Pacheco’s constitutional nor fundamental right.
