Chief electrical engineer gets HC notice

Bombay High Court at Goa on Friday issued show-cause notice to Chief Electrical Engineer Nirmal Braganza in connection with the contempt petition filed by 13 individuals.
Justice A P Lavande issued the notice to show cause as to why contempt proceeding should not be initiated against him, returnable on September 22, 2010.
Kashinath Shetye and twelve others have filed a contempt petition vis-à-vis reappointments of P V Kadnekar as special secretary, law and R A Ghali as electricity inspector, who were appointed in the month of May and July, respectively.
The petitioners have pointed out that the order of extension of reappointment while this court was seized of the matter constitutes contravention of the orders of the High Court and of the Supreme Court.
They have said that extending reappointment of Ghali constitutes a fraud played by the government when already a contempt petition of similar nature was pending.
The petitioner in 2009 had challenged the practice of the government of reappointing retired officials on contract or extension basis.
The High Court on December 1, 2009 had granted the leave to the government partially for a period of five months in which time the government was to frame recruitment rules and make appointments in terms thereof.
The court had also made it clear that no further extension was to be given.
The petitioners pointed out that till date recruitment rules for the post of electricity inspector are not been framed.
Moreover, Kadnekar and Ghali have been reappointed without following the constitutional scheme as spelt out by the Supreme Court.
