HC asks for list of licences issued to premises for measuring sound levels

Tells GSPCB to make a statement on May 6, whether the licenced premises have noise monitoring systems installed and whether such premises are functional

PANJIM: The High Court of Bombay at Goa has asked the licensing authorities to furnish a list premises to which licences have been issued to measure the sound elvels.

The list have to be given to the amicus curiae Adv Nigel Da Costa Frias, while the Goa State Pollution Control Board (GSPCB) has been asked to make a statement on Monday, May 6, whether the licenced premises have noise monitoring systems installed and whether such premises are functional.

Meanwhile, the State government is also likely to notify amended noise action plan on Friday, May 3, which was earlier notified on March 14, 2023, for control of noise pollution. 

While hearing a contempt petition filed by Arnold DSa in public interest litigation (PIL) writ petition, the Court directed the authorities (sub-divisional magistrate) to submit a copy of the list of licences issued to the GSPCB immediately. 

The GSPCB has now been asked to make a statement on May 6 whether these licenced premises had installed noise monitoring systems and further whether such premises are functional. 

Government counsel, Prashil Arolkar told the Court that the amended noise action plan will be positively notified by May 3 and a copy of the notification will be placed before this Court on May 6.

The High Court had earlier directed the North Goa Collector to ensure that there is strict compliance with the Noise Pollution Rules, the action plan and the orders made by this Court from time to time on the issue of noise pollution.

In October last year, the High Court had directed the GSPCB, both District Magistrates, police and other noise pollution monitoring authorities to carry out surprise checks at Anjuna, Arambol and Morjim in Pernemtaluka during the night time especially on weekends and to submit report about the noise pollution status. 

The Court had also directed authorities to confiscate and seal equipment of the establishments found playing loud music beyond stipulated 10 pm thereby violating noise pollution rules.
